RUBBER STAMP OFFICE AND FUNCTION OF PARLIAMENT WITHOUT PRESIDENT

 Rubber Stamp Office :

The office of Parliament is called the Office Of Ceremony but it is a very crucial office in Indian Democracy. We cannot call the Office Of President, a Rubber Stamp Office despite of the fact that he is the Formal Head Executive and generally works on the advice of the Union Council Of Ministers headed by Prime Minister.

    The reasons behind the big "NO" for the Rubber Stamp Office are many more and thay are : 

    💠 ARTICLE 79, which state that President is the part of the Parliament, despite of the fact that he/she is not the member of Parliament.

   ðŸ’ The most crucial reason is that he/she acts as a Friend, Philosopher, Guide to the Prime Minister and help the Legislature with his wisdom and knowledge.

   ðŸ’ The third reason is, we respect our President very much as we call him The First Citizen Of INDIA.

   ðŸ’  Discretionary Power of President cannot be influenced by anyone. As he invites Single Majority Party or Single Majority Pre Pole Alliance to form a responsible and stable government on his own will.

   ðŸ’  Emergency Provision : During Emergency, all the powers gets concentrated in the hands of President.

   ðŸ’ Ordinance : According to ARTICLE 123, President can make law for maximum of 6 months when the legislative is absent. But once thay come in session, thay have to approve that bill with in 6 Weeks Otherwise that Law will become null and void.


So, After Reading These All Reasons, We Can Say That OFFICE OF PRESIDENT Is Not A Rubber Stamp Office.


Needs And Responsibility Of President In The Functioning Of The Parliament : 

 The Parliamentary proceedings cannot progess untill the involvement of the President of INDIA. Lots of the reasons are thre to prove but in ARTICLE 79, it has been clearly stated that, Parliament consists of Lok Sabha + Rajya Sabha + President.

      🔷Assent Power Of President On Bills.

          the process to make Laws out from the Bills follow these steps : 

     BILLS ➖ (passed by LS) ➖ (passed by RS)  (assented by the president) ➖ LAWS/ACTS 

      Here, we can see that no bill can become a law untill it is assented by the President of India. In this regard, President have certain more powers....

     ðŸ”·Veto : Absolute, Suspensive, Pocket 

     veto is enjoyed by the President as he/she wants that Legislature would get some more time to review the concern bill. And like this, he works as a Friend, Philosopher, and Guide.

             ✳️ Absolute Veto : Enjoyed by the President for the bill of the Private Members.

              ✳️ Suspensive Veto : When President want to send recommendations regarding the Bill to the house, then he uses the power of Suspensive Veto but for only once. When the Bill comes to the President for the second time, he/she has to give assent to the Bill.

              ✳️Pocket Veto : While exercising this Veto, President neither give assent nor send it for recommendations. That's the reason that it is known as withholding the Bill. The time period for this Veto is infinite in INDIA.

      🔷In The Recess/Prorogation Of Parliament : 

   President plays a very important role in ending the session

Like the same in the beginning/summoning of Parliament : President plays a very important role in starting the session.

     ðŸ”· President to be called as a Functional Part Of Parliament.

              🔸It is the President only who calls for a joint session to break the dead lock ( ARTICLE 108)

              🔸The dissolution of the house is done by the President on the advice of P.M. 

    🔷 Ordinance : President have a Legislative Power although for a limited period of time.Rubber stamp office
